Terms of Service and acceptable use

What you agree to when you use the Service, what is not allowed on our platform, and what we do when we find a breach. Please read it all before signing up.

These terms are an agreement between ThailandHosting (“the Provider”, “we”) and the person or organisation that signs up for or uses the service (“the Customer”, “you”). They cover the website builder, Business Apps, WordPress, Database, Container, Static Web, Mail, networking, AI and every other service we offer (“the Service”).

We only host lawful businesses. We do not accept gambling sites, scams or any “grey-area” business, however much is paid, whether or not it is claimed to be legal elsewhere, and however it is disguised. Accounts that break this are suspended immediately without notice, and we cooperate fully with the authorities.

1. Accepting these terms

  • By signing up, ticking to accept, or using any part of the Service, you confirm you have read, understood and agree to be bound by these terms, including the policies and prices shown in the Console and on the pricing page, which form part of these terms.
  • You must be of legal age, or have the consent of your legal guardian.
  • If you sign up for a company, shop or organisation, you confirm you are authorised to bind it, and it is bound by these terms together with you.
  • If you do not accept any part of these terms, do not use the Service.

2. Our role as a service provider

We are a technology and hosting provider only (a service provider within the meaning of Thailand’s Computer Crime Act). You understand and agree that:

  • Websites, apps, text, images, products, services, email, data and businesses on the Service (“Content”) are yours: created, chosen, published and controlled by you. We are not the author, publisher, editor, seller, agent, broker, partner or joint venturer of your Content or business.
  • We do not review or approve Content before it is published. Content being on our systems, for however long, does not mean we know of, consent to, endorse or agree with it.
  • Our subdomains (such as yourshop.thailandhosting.com), HTTPS certificates, a “Built with ThailandHosting” badge or the use of our templates do not mean we own, operate or endorse that website.
  • Business Apps (shop, food ordering, booking): buyers pay the shop’s PromptPay or other account directly. We do not receive, hold or transfer money for the shop, are not a payment provider, and are not a party to any sale or booking between the shop and its customers. Disputes about goods, delivery, refunds or quality are between the shop and its customers.
  • AI output is a draft you must check before publishing. Once you publish it, it is your Content.
  • We have the right, but not the duty, to review Content or usage. Not acting on any Content is not consent or a waiver.

3. Your responsibilities

  • You alone are responsible for all Content and all actions from your account, including those of team members, people you invite to a Project, staff using shop logins (Shop Team), and your own clients if you resell or build sites for others.
  • Run your business lawfully and hold every licence, registration or approval the law requires, such as e-commerce registration, Thai FDA numbers, tour operator, liquor or professional licences, or approval from financial regulators.
  • Describe and advertise products truthfully, in line with consumer protection law, without exaggerated claims.
  • Comply with personal data protection law (PDPA) as the data controller for your own customers and visitors, including publishing your own privacy notice.
  • Pay the taxes of your own business.
  • Keep your password and account access safe, and tell us at once if you suspect unauthorised use.
  • Keep your own backups of important data.
  • If you are unsure whether a business or piece of Content is lawful, ask us through a ticket before publishing. Our silence is never permission.

4. Identity and verification

  • Your information must be true, accurate and current. Do not use another person’s name, email, documents or details.
  • Do not buy, sell, rent, lend or register accounts for others as “mule” accounts, or to hide who really uses them.
  • We may at any time ask you to verify your identity, company details, beneficial owners, licences, the nature of your business or the source of funds, especially before a refund, for top-ups made with digital assets, when balances or usage look unusual, or after a report.
  • If you do not provide it in time, or provide false or unreliable information, we may limit, suspend or end the Service and hold any refund until the check is complete.
  • We may refuse sign-up or service to anyone on reasonable grounds, including people whose accounts were suspended before.

5. Prohibited use

You may not use the Service, directly, indirectly, through others or as part of a larger process, for any of the following, whether it is your main business, a side business, or a single page, link or advert.

5.1 Gambling and games of chance

  • Online gambling of any kind, such as baccarat, slots, casinos, sports betting, online lottery, fishing games, card games, dice, boxing or cockfighting bets, or e-sports betting, including agent, affiliate, sign-up and entrance sites.
  • Review, link-list, tipster, formula, “slot hack” or AI prediction sites, promotion pages or SEO articles that lead users to gambling.
  • Back-office systems, automatic deposit/withdrawal systems, APIs or any service for gambling sites.
  • Overpriced lottery tickets, or unlicensed lotteries or games of chance.

5.2 Fraud and deception

  • Fake or look-alike sites of government agencies, banks, companies, brands, couriers or people, and phishing pages that steal passwords, OTPs or card details.
  • Investment scams, Ponzi or pyramid schemes, fundraising promising unrealistic returns, or unlawful direct selling.
  • Fake online jobs, like-for-pay or review tasks, top-up-for-commission schemes, romance scams or call-centre gang schemes.
  • Selling goods or services that do not exist or are not meant to be delivered, fake reviews, and sites designed to mislead consumers.
  • Forged documents such as ID cards, driving licences, degrees, medical certificates, transfer slips or official papers.

5.3 Illegal or unlicensed finance

  • Informal lending, interest above the legal limit, or unlawful debt collection.
  • Buying, selling, renting or supplying bank accounts, e-wallets, SIM cards or online accounts (“mule accounts”).
  • Money laundering, money exchange, receiving transfers on behalf of others, or offering digital assets, Forex or fundraising without the required licence.
  • Using our Wallet to park, pass on or disguise the origin of money.

5.4 Illegal or restricted goods and services

  • Narcotics, their precursors and paraphernalia.
  • E-cigarettes, pods, e-liquids and electronic hookahs.
  • Cannabis, hemp, kratom or related products in any way or channel the law does not allow.
  • Firearms, ammunition, explosives, weapons and conversion parts.
  • Dangerous or specially controlled drugs, illegal slimming or sex drugs, and supplements, cosmetics or medical devices that are unregistered or claim to cure disease.
  • Counterfeit goods and anything infringing trademarks or copyright.
  • Protected wildlife, animal parts, human organs, and goods banned from import or export.
  • Prostitution, sexual services or procuring people for them, and human trafficking of any kind.
  • Trading personal data, customer databases or leaked data.

5.5 Prohibited content

  • Pornography and unlawful sexual content.
  • Any content showing the sexual abuse of children. Zero tolerance: removed at once, evidence preserved and reported to the authorities in every case.
  • Publishing other people’s images or private data without consent, threats, harassment or blackmail.
  • Defamation, false information that causes harm or panic, or content that breaks the Computer Crime Act.
  • Promoting terrorism, violence or hatred.
  • Copyright infringement, such as pirated films, series, live sports, comics or manga, pirate IPTV, cracked software, or templates and themes you have no right to use.

5.6 Abuse of the platform

  • Spam, bulk email to people who did not consent, or purchased mailing lists.
  • Malware, viruses, ransomware, phishing kits, command-and-control servers, botnets or distributing harmful software.
  • Attacking or trying to break into any system: vulnerability scanning, password guessing or DDoS, including stresser or booter services.
  • Running proxies, VPNs or relays for others to hide their identity while committing offences.
  • Cryptocurrency mining, or using resources in ways that are not normal use of the Service.
  • SEO spam, doorway pages, private blog networks, injected links or redirects to unlawful sites, click fraud, fake likes or fake accounts.
  • Opening several accounts to reuse the Free plan, get around quotas or avoid payment.
  • Interfering with, penetration-testing or reverse-engineering our systems, or accessing other customers’ data.

5.7 Evasion

  • “Front” sites that look like a normal business but take payments, sign-ups or send users to prohibited activity.
  • Showing different content by visitor, country, device or time (cloaking) to hide prohibited content from us or the authorities.
  • Changing domains, moving accounts or opening new ones to get around blocking orders, court orders or our suspension.
  • Using wording, codes, abbreviations or images to disguise prohibited activity.

We judge by what an activity really is, not by the name or description you give it. Anything unlawful under Thai law, the law where you do business, or the law of the country you target is prohibited. “It is legal abroad”, “I only built the site for a client” or “it is only a link” are not exceptions.

6. Review, suspension and removal

To prevent harm to others and to comply with the law, we may take any of the following steps, as the seriousness of the case warrants and at our discretion:

  • Review the Content, settings, usage records and payment details of the account, as far as the review needs.
  • Warn you to fix the problem or remove the Content yourself.
  • Block access to, suspend or delete Content, websites, domains, email or services, in part or in full.
  • Suspend or end the account, and any related account or account used by the same person.
  • Freeze use, transfer and refund of the Wallet balance during the review.
  • Preserve data and evidence, and report to the authorities or relevant bodies.

Immediate suspension without notice

In serious cases, namely gambling, fraud, phishing, malware, child-related content, human trafficking, narcotics, weapons, attacks on systems, spam, orders from a court or the authorities, or anything that could harm others, our systems or our reputation, we may suspend at once without prior notice.

Other cases

We will tell you in the Console or by the email you signed up with and give a reasonable time to fix it. If it is not fixed in time, or the breach repeats, we may act under this section at once.

Appeals

If you think we acted in error, open a ticket with evidence, such as your licence or proof you hold the rights to the Content. We will review it and tell you the outcome. Our decision is final as far as the provision of the Service is concerned.

Action taken in good faith under this section does not make us liable for any loss to you or anyone else, including lost revenue.

7. Reporting unlawful content

Anyone can report unlawful use or a breach of these terms, with or without an account, through the abuse report form, by emailing [email protected] or by opening a ticket from the Console. Every report gets a reference number. Please include:

  • The URL or domain concerned.
  • What the breach is, with evidence such as screenshots.
  • Your name and how to reach you.
  • For copyright or trademark claims, proof that you own the rights.

We follow the notice, suppression and removal procedure set under Thailand’s Computer Crime Act and the Copyright Act. Knowingly false reports may be an offence.

8. Cooperation with authorities and data retention

  • We keep computer traffic data (such as the address, time and destination of access to websites, email and databases) and sign-in history for at least 90 days as the law requires, and longer when the authorities order it or it relates to an investigation or case.
  • We disclose account, payment, usage and Content data to officials, courts or bodies empowered by law when we receive a lawful order or request, including under the measures against technology crime.
  • We may not tell you about such a request if the law or the authorities forbid it, or if telling you could affect an investigation.
  • We may report suspected unlawful activity to the relevant bodies on our own initiative, without your consent.
  • Even after an account is ended or deleted, we may keep the data needed to comply with the law or to serve as evidence.

9. Payment, Wallet and refunds

  • Prices, plans and usage charges are those shown on the pricing page and in the Console at the time of use.
  • Wallet balance is credit for our Service only. It is not a deposit, earns no interest and cannot be transferred to another customer.
  • Refunds follow the policy shown in the Console. We refund only to the original payment channel or account, in the name of the original payer, and may ask for proof of identity first.
  • If an account is suspended or ended for breaking section 5, we may keep fees already paid and hold the remaining balance to cover losses, costs, or as ordered by the authorities.
  • If you reverse a payment or file a chargeback without good reason, we may suspend the account until it is paid in full.

10. Content and intellectual property

  • You keep ownership of your Content and allow us to store, copy, cache, back up, convert and display it only as needed to provide the Service.
  • You confirm you have the rights to everything you upload or publish, and that it does not infringe anyone else’s rights.
  • Our software, Console, templates, illustrations and trademarks belong to us. Templates and media we provide may only be used on sites hosted on our Service.

11. Personal data

  • We use your personal data only as needed to provide the Service, bill you, keep it secure, prevent abuse and comply with the law, under Thailand’s Personal Data Protection Act B.E. 2562 (2019).
  • For the data of your own customers and visitors (such as orders, bookings and form messages), you are the data controller and we are a processor acting on your instructions, only to provide the Service.
  • What we collect, use and share, and your rights, are set out in our Privacy Policy.

12. Service availability

  • The Service is provided “as is” and “as available”. We work to keep it running and secure, but do not guarantee it will be uninterrupted, error-free or fit for your particular purpose, unless agreed in writing in an Enterprise contract.
  • We may carry out maintenance, change or withdraw features. For changes that affect you materially, we will give reasonable notice.
  • We are not responsible for events beyond our reasonable control, such as natural disasters, power or network failures, cyberattacks, third-party outages or government orders.

13. Limitation of liability

  • We are not liable for the Content, goods, services, transactions or actions of customers or third parties, nor for disputes between a customer and its own customers.
  • To the extent the law allows, we are not liable for indirect or special loss, or loss of profit, revenue, data, business opportunity or reputation.
  • Our total liability to you, for any cause, is limited to the fees you actually paid us in the 3 months before the event.
  • These limits do not apply to liability the law does not allow to be limited, such as our wilful misconduct or gross negligence.

14. Indemnity

You agree to indemnify and defend us, our directors, staff and partners against claims, lawsuits, prosecutions, fines, damages and costs (including legal fees and the cost of cooperating with the authorities) arising from:

  • Your Content, goods, services or business.
  • A breach of these terms or the law by you, your team or your clients.
  • Harm to our systems, resources or reputation, or our IP addresses and domains being blocklisted, because of your use.

We may deduct such losses and costs from your Wallet balance and claim any shortfall.

15. Ending the Service

  • You may cancel services or close your account at any time from the Console, after deleting your remaining websites and services. A wallet balance not refunded before closing is given up.
  • We may end the Service if you break these terms, do not pay, on the order of the authorities, or when we stop offering that service, with reasonable notice, except in the cases in section 6, where we may suspend at once.
  • After termination we may delete your data within the period shown in the Console, except data that must be kept under section 8.
  • If an account is ended because of unlawful Content, we have no duty to hand over or allow export of that unlawful Content.
  • Sections 2, 8, 9, 13, 14 and 16 survive the end of the Service.

16. Governing law

  • These terms are governed by Thai law, and disputes fall under the jurisdiction of the Thai courts.
  • If any provision is unenforceable, the rest remain in force, and that provision is read as close to its original intent as the law allows.
  • Not exercising a right under these terms does not waive it.
  • These terms exist in several languages. If they conflict, the Thai version prevails.

17. Changes to these terms

We may update these terms from time to time. For material changes we will notify you in the Console or by email at least 15 days in advance, except changes required by law or made to prevent abuse or protect security, which take effect at once. Continuing to use the Service after the new terms take effect means you accept them.
